Piqo Terms of Service

These Terms of Service (hereinafter the "Terms") set forth the rights, obligations, and responsibilities between the Piqo operating team (hereinafter the "Company") and users in connection with the use of the mobile application, related web pages, customer support, paid subscriptions, affiliate links, and other supplementary services (hereinafter collectively the "Services") provided by the Company.

Article 1 (Purpose)

The purpose of these Terms is to establish the conditions and procedures for using the Services provided by the Company, the rights, obligations, and responsibilities of the Company and users, and other necessary matters.

Article 2 (Definitions)

The meanings of the terms used in these Terms are as follows.

  1. "Services" means the Piqo application provided by the Company and all related features.
  2. "User" means a member or non-member who uses the Services in accordance with these Terms.
  3. "Member" means a person who creates an account and logs in through email, Google, Apple, or another method permitted by the Company to use the Services.
  4. "Content" means any text, images, data, scores, ingredient information, regulatory information, Halal-related information, routine summaries, links, and any other information or materials displayed or provided within the Services.
  5. "Paid Services" means subscription-based or other supplementary services provided by the Company for separate consideration.
  6. "Affiliate Links" means links that connect users to external retailers or third-party sites and through which the Company may receive a commission or comparable economic benefit.

Article 3 (Posting and Amendment of the Terms)

  1. The Company posts the contents of these Terms within the Services' settings screen, on web pages, or in another manner accessible to users.
  2. The Company may amend these Terms within the scope that does not violate applicable laws.
  3. When the Company amends these Terms, it specifies the effective date and the reason for the amendment and provides notice for a reasonable period prior to the effective date.
  4. If a user continues to use the Services after the effective date of the amended Terms, the user is deemed to have agreed to the amended Terms.
  5. If a user does not agree to the amended Terms, the user may discontinue use of the Services and request to withdraw membership.

Article 4 (Formation of the Service Agreement)

  1. The service agreement is formed when a user agrees to these Terms, completes the registration procedure established by the Company, and the Company approves it.
  2. The Company may refuse registration or subsequently terminate the service agreement in any of the following cases.
    1. Where the user has misappropriated another person's information or authority
    2. Where the user has provided false or inaccurate information
    3. Where the user intends to use the Services for a purpose that violates applicable laws, public order, or good morals
    4. Where there is a concern that the user may obstruct the Company's operations or cause a serious risk to the stability of the Services
    5. Other cases that the Company reasonably deems inappropriate
  3. Some or all of the Services may be used only after membership registration and login have been completed.
  4. Minors must use the Services with the consent of their legal representative, and the Company may verify such consent where necessary.

Article 5 (Account Management and Security)

  1. Members must keep their account information accurate and up to date.
  2. Members must manage their own account, password, and login credentials, and must not transfer, lend, or share them with any third party.
  3. If account misappropriation or a security issue occurs, members must notify the Company immediately.
  4. The Company is not liable for any damage arising from a member's negligence in account management, unauthorized use, or other causes attributable to the member, unless the damage results from the Company's intent or gross negligence.

Article 6 (Contents of the Services)

The Company may provide the following Services.

  1. Cosmetics barcode scanning and product search
  2. Recognition of product names and ingredient lists through OCR
  3. Ingredient safety analysis, country-specific regulatory information, and related scores
  4. Ingredient combination information, routine management, and routine summaries
  5. Halal-related filters, badges, and analysis information
  6. Scan history, favorites, notifications, and settings features
  7. Country- or region-based store links and purchase guidance
  8. Acceptance of customer inquiries, bug reports, and product registration requests
  9. Paid subscriptions and related benefits
  10. Other related services additionally provided by the Company

The Company may change, add, restrict, or discontinue all or part of the Services for operational, technical, policy, or legal reasons.

Article 7 (User Obligations and Prohibited Conduct)

In using the Services, users must not engage in any of the following conduct.

  1. Entering false information, misappropriating another person's information, or creating an account through fraudulent means
  2. Infringing the rights of the Company or third parties
  3. Intruding upon, circumventing, abnormally accessing, making automated bulk calls to, scraping, reverse-engineering, or otherwise obstructing the operation of the Services, application, servers, databases, or networks
  4. Uploading, transmitting, posting, or using illegal materials, rights-infringing materials, false materials, or materials contrary to public order
  5. Obstructing the operation of the Services by using malicious code, viruses, spam, automated programs, or the like
  6. Commercially using, reproducing, distributing, transmitting, editing, or reselling the Services or Content without the Company's prior permission
  7. Infringing the rights of others or submitting materials that differ from the facts through product registration requests, inquiries, bug reports, image uploads, or other input features
  8. Other conduct prohibited by the Company for the stable operation of the Services

Article 8 (User-Submitted Materials)

  1. The user who uploads or submits photos, text, inquiry content, product registration request information, or other materials to the Services is responsible for such materials.
  2. Users warrant that the materials they submit are lawful and do not infringe the rights of any third party.
  3. The Company may process materials submitted by users for the purposes of providing the Services, conducting review, improving quality, analyzing errors, providing customer support, responding to security incidents, and operating related features.
  4. The Company may reject, delete, or restrict the use of materials that may violate applicable laws, infringe rights, be falsely submitted, be misused, or impair the operation of the Services, without prior notice.

Article 9 (Paid Services, Subscriptions, and Payment)

  1. The Company may provide paid subscriptions or other Paid Services. The specific product details, prices, provision periods, scope of benefits, and whether automatic renewal applies follow the information displayed on the payment screen within the Services or on the app marketplace screen.
  2. Payment, renewal, cancellation, and refunds for Paid Services may also be subject to the policies of the Apple App Store, Google Play, or the payment platform designated by the Company.
  3. Where a free trial is offered, it may convert to a paid subscription after the trial ends unless separately canceled.
  4. Users may cancel their subscription through the method provided by each app marketplace or payment platform.
  5. The Company may change the composition, price, or provision conditions of Paid Services within the scope permitted by applicable laws and payment platform policies, and provides advance notice of any material change.

Article 10 (Advertising, Affiliate Links, and External Services)

  1. The Company may display advertisements within the Services, and users may be exposed to advertisements in the course of using the Services.
  2. The Company may connect users to external retailers, marketplaces, or third-party websites through affiliate links, and where a user purchases a product or service through such a link, the Company may receive a commission or economic benefit.
  3. Where necessary, the Company may disclose that a link is an affiliate link so that users can recognize it.
  4. Product information, prices, stock, delivery, payment, refunds, exchanges, quality, and other transaction conditions provided by external retailers are the responsibility of the relevant retailer or third party.
  5. Once a user moves to an external site or third-party service, the terms and policies of the relevant operator apply.
  6. The Company does not guarantee the content, availability, accuracy, legality, or transaction outcomes of external sites, third-party services, or external retailers.

Article 11 (Intellectual Property Rights)

  1. Intellectual property rights in the Services, application, design, trademarks, logos, text, images, data composition, analysis logic, software, and all other elements belong to the Company or the rightful holder.
  2. Users may not reproduce, modify, distribute, transmit, display, publish, reverse-engineer, or create derivative works from all or part of the Services without these Terms or the Company's express permission.
  3. Some data within the Services may be based on external public data, public data, open data, or third-party licenses. Specific sources and license matters are provided on the "Data Sources and Licenses" page within the Services or in a separate notice.

Article 12 (Protection of Personal Information)

The Company strives to protect users' personal information in accordance with applicable laws. Matters concerning the collection, use, retention, destruction, provision to third parties, and entrustment of processing of personal information, as well as users' rights, are governed by the separately posted Privacy Policy.

Article 13 (Nature of the Services and Limits of the Information Provided)

  1. The Services are information-providing services that offer information about cosmetic ingredients, products, regulatory information, routine management, Halal-related information, store links, and the like.
  2. Content within the Services is provided as general reference information and does not replace medical practice, diagnosis, prescription, a pharmacist's medication guidance, or the individual advice of a dermatologist or other professional.
  3. Users must make their own judgment by comprehensively considering their skin condition, allergy history, pregnancy status, religious standards, intended use, and product characteristics, and must consult an appropriate professional such as a physician, pharmacist, dermatologist, or accredited certification body where necessary.
  4. Among Halal-related information, ingredient-based analyses, estimates, or classification results that are not official certifications are for reference only and do not replace accredited Halal certification or religious or legal judgments.
  5. The Company does not guarantee the accuracy, timeliness, completeness, suitability, freedom from error, or fitness for a particular purpose of information based on OCR results, external data sources, public data, open data, third-party APIs, automated analysis logic, or statistical models.
  6. Due to update delays, errors, omissions, or duplications in external data sources, or differences in country-specific regulations, discrepancies may arise between the information within the Services and actual product information or actual regulatory status.

Article 14 (Changes to and Suspension of the Services)

  1. The Company may temporarily suspend the provision of the Services for reasons such as system maintenance, updates, incident response, security enhancement, changes to external services, or changes in laws or policies.
  2. The Company may, where necessary, change the structure, features, design, pricing policy, scope of support, or countries of provision of the Services.
  3. Where there is a material change, the Company notifies users through in-service notices, electronic means, or other reasonable methods.

Article 15 (Restriction of Use and Termination of the Agreement)

  1. If a user violates these Terms or applicable laws, the Company may restrict use of the Services or suspend or terminate the account.
  2. Users may request to withdraw membership at any time through the method provided within the Services or the method guided by the Company.
  3. Even upon membership withdrawal or termination of the service agreement by the Company, information that must be retained under applicable laws, records necessary for dispute resolution, or the minimum information necessary to prevent fraudulent use may be retained for a certain period in accordance with applicable laws and Company policies.
  4. Even after termination of the service agreement, provisions that by their nature must survive, such as those concerning intellectual property rights, limitation of liability, processing of personal information, governing law, and dispute resolution, remain in effect.

Article 16 (Damages and Limitation of Liability)

  1. The Company is not liable for service failures caused by natural disasters, war, riots, power outages, communication failures, platform policy changes, external API failures, third-party service interruptions, app marketplace restrictions, or other causes beyond the Company's reasonable control.
  2. The Company is not liable for service usage failures caused by reasons attributable to the user.
  3. The Company does not guarantee the profits, utility, purchase outcomes, religious judgment outcomes, health outcomes, or other economic or non-economic results that a user expects to obtain through the Services.
  4. The Company is not liable for damage caused by the acts of external retailers, third-party services, advertisements, affiliate links, external pages, external login services, payment platforms, data providers, or carriers, unless the damage results from the Company's intent or gross negligence.
  5. Unless caused by the Company's intent or gross negligence, the Company is not liable for indirect, special, incidental, or consequential damages, data loss, business losses, or loss of expected profits arising in connection with the use of the Services.
  6. Even where the Company's liability is recognized, its scope is limited to the extent permitted by applicable laws.

Article 17 (Governing Law and Dispute Resolution)

  1. These Terms are governed by the laws of the Republic of Korea. However, where there are mandatory consumer protection laws applicable in the user's place of residence, such laws may apply with priority.
  2. Any dispute arising between the Company and a user shall first be resolved through good-faith consultation.
  3. Disputes not resolved through consultation shall be subject to the court having jurisdiction under applicable laws as the court of first instance.
